These Terms and Conditions (“Terms”) govern your use of rorystravelclub.com (the “Site”) and your purchase and use of a Rory’s Travel Club membership.

Please read these Terms carefully before purchasing a membership. By creating an account, purchasing a membership or otherwise using our paid membership services, you agree to be bound by these Terms.

Nothing in these Terms affects any statutory rights you have as a consumer which cannot lawfully be excluded or restricted.

1. ABOUT RORY’S TRAVEL CLUB

Rory’s Travel Club (“RTC”, “we”, “us” or “our”) operates a subscription-based travel membership service through which members receive access to travel offers, hotel offers, travel inspiration, promotions and other member benefits.

2. AGE REQUIREMENT AND ELIGIBILITY

You must be 18 years of age or older to purchase a Rory’s Travel Club membership or enter into a subscription agreement with us.

By purchasing a membership, you confirm that:

  • you are aged 18 or over;

  • you have the legal capacity to enter into a binding agreement;

  • all information you provide is accurate, complete and truthful; and

  • you are authorised to use the payment method provided.

We do not knowingly enter into paid subscription agreements with anyone under the age of 18.

If we reasonably believe that a membership has been purchased directly by a person under the age of 18, we may suspend or cancel that membership and, where appropriate, refund payments in accordance with applicable law.

An adult aged 18 or over may purchase a membership or travel product for the benefit of another person where permitted. However, the person entering into the subscription agreement and providing payment details must be aged 18 or over.

Individual hotels, airlines, tour operators, cruise providers, attractions and other travel suppliers may impose their own minimum-age requirements for booking, check-in, travel or participation. Members are responsible for checking these requirements before making a booking.

3. OUR MEMBERSHIP SERVICE

Rory’s Travel Club is a subscription membership service which provides members with access to travel-related offers, promotions, information and other benefits.

Membership does not guarantee the availability of any particular hotel, destination, travel product, rate or offer.

Unless expressly stated otherwise, RTC is not the hotel, airline, tour operator, travel agent or other travel supplier providing the underlying travel service.

Where a member chooses to make a booking directly with a third-party hotel or travel provider, a separate contract is normally formed between the member and that provider.

The provider's own booking terms, cancellation policy, payment terms, age restrictions and other conditions will therefore apply to that booking.

Members should review those terms carefully before completing any booking.

4. MEMBERSHIP FEES

The applicable membership price will be clearly displayed before you complete your purchase.

All prices will be displayed in the applicable currency and will include applicable taxes where required by law.

We may offer different membership prices, promotional rates, introductory offers, corporate memberships or discounted memberships from time to time.

Any conditions associated with a promotional or discounted membership will be displayed or communicated before you purchase or activate that membership.

We may change our standard membership price from time to time.

Where a price change affects the renewal of an existing subscription, we will communicate the new price in advance where required by law.

A price change will not retrospectively affect a membership period which has already been paid for.

5. SUBSCRIPTION TERM AND AUTOMATIC RENEWAL

Where you purchase an annually renewing RTC membership, your membership will continue for the subscription period stated when you join.

If your membership is an automatically renewing subscription, this will be clearly explained before you complete your purchase.

Before purchasing an automatically renewing membership, we will provide information including:

  • the membership price;

  • the initial subscription period;

  • that the membership automatically renews;

  • how frequently renewal occurs;

  • the renewal price, or how that price will be determined; and

  • how you can cancel future renewal.

Unless you cancel before the applicable renewal date, your membership will renew and the applicable membership fee will be charged using your selected payment method.

We will provide renewal reminders and other subscription notices where required by applicable UK consumer law.

6. CANCELLING AUTOMATIC RENEWAL

You may cancel the automatic renewal of your membership at any time before your next renewal payment becomes due.

Cancellation can be made through the customer portal by signing into the website or by contacting:

Cancelling automatic renewal does not normally terminate your existing paid membership immediately.

Unless otherwise stated, your membership and member benefits will remain available until the end of the subscription period for which you have already paid.

You will not then be charged for a further subscription period.

7. 14-DAY COOLING-OFF PERIOD

Where you purchase an RTC membership online as a consumer, you may have a statutory right to cancel the contract within 14 days of entering into it without giving a reason, subject to applicable consumer law.

To exercise your statutory cancellation right, you must clearly inform us of your decision to cancel.

Where you validly exercise a statutory cancellation right, we will provide any refund due in accordance with applicable consumer law.

Where you expressly request that membership services or benefits begin during the statutory cancellation period, this may affect the amount of any refund where permitted by law. Any relevant information or consent required in relation to the commencement of services during the cancellation period will be presented to you as part of the purchase process.

Your statutory cooling-off rights are separate from your ability to cancel future automatic renewal.

Nothing in these Terms limits any statutory cancellation or refund rights available to you.

8. MEMBER OFFERS

RTC works with hotels, travel companies and other third-party providers to make travel offers available to our members.

Unless expressly stated otherwise:

  • offers are subject to availability;

  • blackout dates may apply;

  • specific room types or other inventory may be restricted;

  • minimum stays may apply;

  • individual providers may impose their own booking and cancellation conditions;

  • prices and availability may change;

  • offers may not be available on every date;

  • offers may not be combined with other promotions or discounts; and

  • offers may be withdrawn, replaced or amended.

We aim to ensure that the information communicated to members is accurate when published.

However, travel inventory and availability can change quickly and genuine errors may occasionally occur.

Where we become aware of a material error in an offer, we will take reasonable steps to correct the information as soon as reasonably practicable.

9. BOOKINGS WITH THIRD-PARTY PROVIDERS

Where you make a booking directly with a hotel, airline, tour operator, cruise company or other third-party provider, your booking will be subject to that provider's terms and conditions.

You are responsible for checking your booking details before completing the transaction, including:

  • dates of travel;

  • guest or passenger names;

  • room or accommodation type;

  • package inclusions;

  • meals or other included benefits;

  • payment requirements;

  • cancellation and amendment conditions;

  • passport and visa requirements where applicable;

  • insurance requirements; and

  • any restrictions imposed by the provider.

Unless RTC is expressly identified as the contracting travel provider or organiser for a particular product, RTC is not the supplier of that travel service.

Nothing in these Terms excludes any responsibility which RTC has under applicable law.

10. PRICING, SAVINGS AND COMPARISONS

Where RTC describes an offer as providing a saving or compares an RTC member rate with another price, the basis of that comparison will be stated or reasonably identifiable.

Travel prices are dynamic and can change according to dates, demand, availability, room type and other factors.

We therefore cannot guarantee that an RTC offer will always be the cheapest price available through every booking channel at every point in time.

11. MEMBER ACCOUNTS

When creating and using an RTC account, you agree that:

  • the information you provide will be accurate, complete and up to date;

  • you will keep your login information and password secure;

  • you will not knowingly permit fraudulent or improper use of your account;

  • you will notify us if you become aware of unauthorised use of your account; and

  • you will update your information where relevant.

Memberships are intended for the registered member and must not be resold or commercially exploited unless expressly authorised by RTC.

We may suspend or terminate an account where we reasonably believe that it is being used fraudulently, unlawfully or in serious or repeated breach of these Terms.

Where reasonably practicable, we will explain the reason for suspension or termination.

12. FREE, TRIAL AND PROMOTIONAL MEMBERSHIPS

From time to time, RTC may provide free, discounted, trial or promotional memberships.

These may be provided directly by RTC or through employers, employee benefit providers, reward platforms, commercial partners, promotional campaigns or promotional codes.

Additional eligibility requirements, expiry dates or restrictions may apply.

These will be communicated as part of the relevant promotion where applicable.

Where a free or promotional membership will subsequently convert into a paid subscription, the future payment obligation, price and applicable renewal terms will be clearly communicated before the member becomes liable for payment.

We will not charge a member merely because a free promotional membership has ended unless the member has agreed to the applicable paid subscription and payment terms.

13. CORPORATE AND EMPLOYEE BENEFIT MEMBERSHIPS

RTC memberships may be provided through employers, benefits platforms or other organisations.

Additional arrangements may exist between RTC and the organisation providing access to the membership.

Where appropriate, members will be informed of any material conditions affecting their individual membership, including its duration or eligibility requirements.

If access to RTC is dependent upon employment or membership of another organisation, eligibility may end when the underlying relationship ends.

14. INTELLECTUAL PROPERTY

All content published or made available through the Site, including text, branding, graphics, logos, photographs, videos, documents, downloadable materials and website design, is owned by or licensed to RTC unless otherwise stated.

You may access and use this content for personal, non-commercial purposes.

You must not reproduce, distribute, modify, sell, commercially exploit or republish RTC content without our prior written permission except where permitted by law.

15. THIRD-PARTY GOODS AND SERVICES

Our Site and communications may feature goods and services supplied by third parties.

The inclusion or promotion of a third-party service through RTC does not mean that RTC is the supplier of that service unless expressly stated otherwise.

Third-party suppliers remain responsible for the goods or services they provide and for complying with their own legal obligations.

16. LINKS TO OTHER WEBSITES

Our Site, emails and other communications may contain links to websites operated by third parties.

We do not control those websites and are not responsible for their content, security, availability, terms or privacy practices.

Members should review the applicable terms, booking conditions and privacy information before entering into a transaction with a third party.

17. ACCEPTABLE USE

You must not use our Site, membership or services:

  • for unlawful or fraudulent purposes;

  • to interfere with the operation or security of our Site;

  • to attempt to obtain unauthorised access to another person's account;

  • to scrape, systematically copy or reproduce member offers without permission;

  • to resell RTC memberships or member benefits without authorisation;

  • to misuse promotional codes or membership offers; or

  • in a manner which materially harms RTC, our members or our commercial partners.

18. AVAILABILITY AND CHANGES TO THE SERVICE

We aim to keep our Site and membership service available but cannot guarantee uninterrupted access at all times.

We may temporarily restrict access for maintenance, security, technical reasons or circumstances outside our reasonable control.

RTC is an evolving membership service. We may therefore introduce, change or discontinue individual features, partnerships, benefits or types of offers from time to time.

We will not make changes which unlawfully remove or materially reduce contractual rights for which a member has already paid.

19. LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability which cannot legally be excluded or limited.

RTC is responsible for losses which are a foreseeable consequence of our breach of these Terms or our failure to exercise reasonable care and skill.

Where RTC is not the supplier of the underlying travel service, we are not responsible for losses caused solely by the acts or omissions of an independent hotel, airline, tour operator or other third-party provider where RTC is not legally responsible for that provider.

We are not responsible for losses which were not reasonably foreseeable when the contract was entered into.

RTC memberships are intended primarily for personal consumer use. We are not responsible for business losses arising from a consumer using their membership for commercial purposes.

Nothing in these Terms affects your statutory rights as a consumer.

20. TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS

Members are responsible for ensuring that they have appropriate travel documentation and meet applicable travel requirements.

This may include:

  • passports;

  • visas;

  • entry permits;

  • health documentation;

  • immigration requirements; and

  • any documentation required by a travel provider.

Travel and entry requirements can change.

Members should therefore check current official government advice and the requirements of their travel provider before travelling.

We strongly recommend that members obtain appropriate travel insurance for their circumstances and intended trip.

21. PRIVACY AND PERSONAL INFORMATION

We process personal information in accordance with our Privacy Policy and applicable data protection legislation.

Our Privacy Policy explains how we collect, use, store and protect personal information and describes your data protection rights.

By creating an account, you acknowledge that you have had the opportunity to review our Privacy Policy.

Marketing communications will be handled in accordance with applicable privacy and electronic marketing requirements.

22. CHANGES TO THESE TERMS

We may update these Terms where reasonably necessary, including to reflect:

  • changes in law or regulation;

  • changes to our services;

  • changes to membership features;

  • changes to technology or payment systems; or

  • legitimate changes to the operation of our business.

Where a change materially affects an existing member's rights or obligations, we will provide reasonable advance notice where required by law.

Changes will not remove statutory rights which have already arisen.

The latest version of these Terms will be available through our Site.

23. TERMINATION

You may cancel your membership or future renewal in accordance with the cancellation provisions contained in these Terms.

We may suspend or terminate a membership where there has been:

  • fraud or suspected fraud;

  • deliberate misuse of membership benefits;

  • non-payment;

  • unlawful use of the service; or

  • a material or repeated breach of these Terms.

Where appropriate and reasonably practicable, we will provide notice and explain the reason for termination.

Termination does not affect rights or liabilities which arose before the date of termination.

24. SEVERABILITY

If any provision of these Terms is found by a court or competent authority to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary.

The remaining provisions will continue to apply.

25. GOVERNING LAW AND CONSUMER RIGHTS

These Terms will be governed by the law applicable to the RTC contracting entity and the consumer, subject to any mandatory rights available to consumers under applicable UK law.

If you are a consumer resident in England, Wales, Scotland or Northern Ireland, nothing in these Terms deprives you of any mandatory consumer protections available to you under the laws applicable where you live.

Nothing in these Terms prevents you from bringing proceedings in a court which you are entitled to use under applicable consumer law.

27. IMPORTANT INFORMATION

These Terms should be read alongside our:

  • Privacy Policy;

  • Cookie Policy;

  • individual offer terms where applicable;

  • competition terms where applicable; and

  • any specific conditions communicated as part of a promotional or corporate membership.

Where specific terms apply to a particular promotion or offer, those specific terms will apply in addition to these Terms.

Nothing contained in these Terms is intended to restrict or exclude rights which cannot lawfully be restricted or excluded under applicable consumer law.
